If you live in the residence of California, it is a good idea to know what laws, regulations and protections the state has created regarding car insurance. Understanding California state auto insurance laws will acquire shopping for a policy grand easier, and will allow you to make decisions based on your inherent rights as a resident of the Golden State.

Access to Auto Insurance Quotes

According to the California Department of Insurance, the state of California passed Assembly Bill 2677 in 2004, which requires all insurance companies operating within the state to give customers access to quotes or estimates at the lowest rate available to them. This means that California auto insurance laws ensure that consumers obtain accurate information when shopping for insurance policies.

AB 2677 mandates that insurance companies provide either a toll-free telephone number or a web station at which consumers can procure those quotes. In California, the insurance company must provide the consumer with a “cost estimate of its lowest priced personal auto policy at the limits the consumer requests and for which the consumer is eligible.” This makes it illegal for insurance companies to overcharge customers when customers could be getting the same coverage for a lower rate.

Consumer Privacy

Auto insurance laws in California protect consumer privacy by limiting the information brokers and agents can disclose to third parties. Generally, any non-public information is protected, which means that insurance companies can’t use information they have collected in an unauthorized manner. This includes health information; for example, if you are in a car accident, the auto insurance company can’t disclose details of your condition without consent.

Broker Fee Requirements

In California, auto insurance laws also protect consumers from unscrupulous broker fees, and they require insurance companies to disclose all fees prior to signing contracts or accepting payment from consumers. If you know of any insurance company, agent, or broker charging unscrupulous fees, it is critical to recount the Department of Insurance with the details.

California Automobile Assigned Risk Plan

California’s auto insurance laws provide the California Automobile Assigned Risk Plan, which is intended for consumers who are unable to obtain insurance the standard way. In other words, if you’ve had too many citations or accidents, normal car insurance companies might not extend a policy to you. In this case, you have access to the CAARP, which will assign you an insurance company with pre-determined rates.

Capping

It is illegal in California for auto insurance companies to refer consumers to legal representatives in exchange for a “finder’s fee.” Capping is a felony in the state of California, so know that you don’t have to purchase a referral from an insurance agent or broker when you need the assistance of legal counsel.

Auto insurance laws in California are detailed at the California Department of Insurance web space. Notion your rights can protect you from unscrupulous agents and brokers, and will allow you to make informed decisions about your insurance needs.

As numerous individuals can see from watching the television and reading the newspaper several people today are in jeopardy of loosing their American Dream…the homes which persons have worked so difficult to acquire We, my husband and I are 2 of those folks We could not afford to get are own property until about 4 years ago, we raised our youngsters in tiny rental apartments or houses Most of the time with our son and daughter sharing the exact same bedroom As the children got older that wasn’t going to work any extra, so my husband and I began working a lot more hours and saving dollars, cleaning up our credit to perfection We did every thing that we could to get a house for our family.

In Feb of 2003, we accomplished our objective, we bought an inexpensive three bedroom / 2 bathroom property in a nice area of town with a wonderful fresh water canal in the back yard for $94,000 The residence was built in 1975 so it wasn’t ideal, but to us it was the house we hoped and dreamed about for our family to live It was fantastic for the initial time we could decorate our home the way we wanted, we didn’t have to live with pasty white walls, we could have pets…WE OWNED A House!!!!Life was typical for our American family Our teenagers could invite their friends over, there was sufficient room in the yard to play sports, fish in the canal, or just hang out and relax in gorgeous sunny Florida.Until life changed, on August 13, 2004 Hurricane Charlie made a direct hit on our community Our dream property was damaged but repairable, Thank God, but financially we where in trouble As a result of the storm my husband had lost his job, as a individual working in the school system I hadn’t worked all summer so let’s say our reserves had been limited already As I already said we are a typical American working class family, living paycheck to paycheck..After the storm we had lots of assist in the community specifically from The Salvation Army When I went to FEMA and asked for assistance…I got NO assist at all I asked if they could aid with paying 1 month mortgage payment, they couldn’t…but they where willing to put a really high priced trailer in my front yard So I contacted my mortgage corporation and they placed us with unique hurricane assistance department, the quite nice women advised me to get 4 months behind in my mortgage and they would aid us By that time, both myself and my husband had been working and we could pay the monthly payment but we had been behind with about 1 1/2 months mortgage payment They mortgage business kindly advised us to get 4 months behind and since we where at the mercy of those helping us in our community we listened Got a subordinate mortgage which wouldn’t have to be paid until the end of the 30 year loan and every thing was fantastic A couple months later we got a notice stating that our mortgage would be going up $150 per month due to the fact of the homeowners insurance and property taxes growing That was alright we could afford it, my husband and I where working steadily We had both discovered greater paying jobs…life was nice once more The fantastic American dream had come back, going to work, fixing nice meals for the family, going for weekend outings…a basic life but that’s all we wanted.Financially, life was going very good, so it was time to correct an additional dilemma that occurred as a result of the hurricane, we had gotten behind on the credit cards and decided it was time to refinance the home and pay off that debt, we paid off the vehicle payment and figured that since we had stable employment we could deal with the improve of our mortgage We where advised by a various mortgage business that it was a great option to pay off our debts, improve our credit score, etc., etc Of course when we refinanced our credit score wasn’t that very good…you see the prior mortgage corporation had advised us to get 4 months behind and it appeared that we where in pre-foreclosure at that point in time.As I stated just before, we could have paid the mortgage prior to becoming 4 months behind, we did not pay under advise from a mortgage professional When we refinanced we ended up with a especially high adjustable interest rate…but it was worth it trigger we got our debts paid off The mortgage did increased and life was nice…for a although…until I lost my excellent paying job Luckily we had a small cushion in the bank and I was able to collect unemployment, I took the initial job which would hire me at a a lot lower pay rate and we just began living the finest we could…with a few cut backs But, you got to do, what you gotta do…THATS LIFE!At the end of 2006 we received an additional letter from our mortgage business stating that we would have an boost in our escrow, an additional $100 per month…our mortgage has essentially double from it’s original quantity Sadly, our income has not and with the price of gas, food, electricity, and every thing required to survive growing I decided to look for a much better paying job In April 2007, I discovered a full time job which would pay me a lot more per hour and would support offset the improve in our mortgage I knew it wasn’t going to make me rich, but I figured it would be a aid I had to do the proper thing to pay my bills correctly Life was obtaining rough with the boost of gas costs, and my husbands job requiring so significantly driving My mind was set on…we want much more dollars, we require a greater income, we will need to do the proper things to maintain our American Dream going Heres where the nightmare starts, I began my new job in April, not just a job but a step toward my career, you see I have been going to college for over 10 years attempting to get my teaching degree…the other dream This child care center was extremely recommended to me it provided a higher income and fantastic work atmosphere…it sounds superb doesn’t it By the end of May possibly most of the youngsters graduated the program and would be heading to kindergarten, the school attendance dropped considerably as a result I have been working only 30, 24, 12, even three hours a week a my great extremely recommended FULL TIME job In the mean time my husband lost his job and was denied unemployment (that’s an additional story for an additional time) As a result we have been living off of next to nothing for the past many months He will in fact begin working next week at a lower paying job that he is overqualified for but it’s greater then nothing. As I sit here right now, we are nearly 4 months behind on our mortgage payment I have spoken to my present mortgage firm various times attempting to get assistance I have spoken to many other mortgage corporations attempting to refinance or get facts to know and recognize what to do I have searched for a new job, second job any way to make extra income My husband has been looking for a job, traveling miles spending cash like crazy on gas I have contacted many social service agencies in our community with pretty small success We make too a lot cash, we do not make sufficient cash, they do not aid with mortgages, I can’t go rent an additional home yet trigger I still own this 1 When I asked the mortgage organization How lengthy do I have prior to I have to leave this home that can’t say it verbally, I have to wait until I get the letter in the mail.My husband and I are slowly becoming physically and yes mentally sick, we can’t sleep I go to sleep crying, I wake up crying then have to pull myself .

Do you realize that most car insurance companies do not pay a death aid in the case of a fatal automobile accident? One local family in Athens Pennsylvania learned the hard way in September when their 22-year-old daughter Stephanie lost control of her car and was fatally injured. Her full coverage from a nation wide automobile insurance company did not pay the funeral expenses for the young woman.

This is a very favorable reason specifically to ask your automobile insurance company if they have a death benefit in case a death occurs. This map your family is not left having to come up with the host cost of burial and other related expenses in their time of grief as Stephanie’s family has.

Stephanie came from an average small town American family and was in college, as is her younger sister Jen. Both girls worked in addition to college to pay their absorb way, with a microscopic help from their parents. Both girls paid their own automobile insurance for this nation wide company and though they were covered. Their automobile insurance is from the same company their parents have used for years.

At the risk of litigation, I will not name this insurance company but I bet you can guess the name. If you have auto insurance that moves forward rather than discontinue leisurely you have the same one. In my way of thinking if you do carry full insurance you steal, you are covered every possible way. However, you may not be, so check the small print so your family is not paying funeral expenses out of pocket.

Stephanie’s parents have had to come up with all of these related funeral expenses out of pocket. Mother Missy is a home health aide and her father is a truck driver, like most Americans they do not have tons of extra cash sitting around for unexpected expenses such as this. No family such have to pay for such expenses when they have full coverage otherwise. The community had rallied around this family and held a attend to raise some funds to help the family.

Missy is doing many interviews locally to advise the public about the fine print of the automobile insurance company she deal with. She wants to make clear that no other families have to endure the hardship of an insurance company while dealing with the loss of a child. I am quietly doing my share to help Missy and her family to get the word out there. Missy is more than just another family, she is a neighbor, and Jen the younger daughter had been here often. My heart still goes out to this family on the loss of their oldest daughter.

You will salvage very sparse information on this topic, because the companies do not want it to be known. If you are one of the families who learns of this first hand, than you feel the need to get the word out there so the public knows. Forward this article to anyone you know who had automobile insurance company and bug them to check their own policy so they are not caught unexpectedly.

Death coverage on auto insurance policies does not exist.
